Terms and conditions of use

1. Service provider
NFC Magnets is operated by José Navarro Astiasarán, Spanish tax ID 73482428G, with address at Arberoki 5, 31180 Zizur Mayor (Navarra, Spain), telephone +34 689 484 679 and email josenav97@gmail.com.
2. Acceptance of these terms
These Terms govern the website, NFC magnet activation, private albums, media uploads, album access, download tools, shared-gallery features where enabled, support interactions and any related digital service under the NFC Magnets brand.
Initial activation requires an affirmative checkbox by which the user accepts the identified version of these Terms, confirms having read the identified version of the Privacy Policy, and declares responsibility for the content they upload. The checkbox is not preselected and activation is not completed unless it is marked. Later PIN access will not require repeating this action unless NFC Magnets updates the legal versions and asks for a new one-time acceptance.
The person who completes this action confirms that they are old enough and have sufficient capacity and authority to use the album. If they allow another person to use the PIN or upload content, that other person must also comply with these Terms. A Privacy Policy is information about processing and is acknowledged as read; this acknowledgment is not a blanket consent for every data-processing purpose.
3. Legal nature of the service
NFC Magnets combines a physical NFC magnet with a private digital album. The product is designed to preserve memories associated with a person, event, trip, gift, object or place. It is not a public social network, a mass file-hosting service, a professional backup system or a guaranteed permanent archive.
4. Definitions
Album means the private digital space linked to a magnet. Content means photos, videos, descriptions, dates, filenames and any other material uploaded or edited by users. User means any person who activates, accesses, manages or contributes content to an album. Owner or holder means the person who lawfully controls the magnet or album credentials.
5. Activation and access
Each album is linked to an individual URL or route. Activation may require accepting legal policies, selecting a language, creating a PIN, entering an email for certain support or recovery flows and configuring the album name or other presentation elements.
The user must keep the magnet, links, PIN and access information confidential. NFC Magnets may use session controls, failed-attempt limits, temporary locks and audit logs to reduce unauthorized access.
6. PIN and credential responsibility
The PIN is personal to the album holder. Users must avoid obvious numbers, sharing credentials publicly or leaving the magnet in contexts where third parties can access private content. NFC Magnets is not liable for access caused by negligent sharing, weak PIN choices or uncontrolled physical possession of the magnet.
7. Private but not absolute secrecy
Albums are intended to be private and are protected by technical measures. However, any person with valid access information may view the album. Users should upload only content they are comfortable sharing with the intended audience and should maintain their own copies of important files.
8. User content ownership
Users retain ownership of their photos, videos, descriptions and other uploaded materials. NFC Magnets does not acquire ownership over user memories. Users grant NFC Magnets a limited, non-exclusive, worldwide, technical license to host, store, process, resize, generate thumbnails, display, transmit and make available the content only as necessary to operate the album and related support/security features.
9. Rights over people appearing in photos or videos
The person who selects and uploads a file is responsible for that decision and declares that the content is lawful; that they own it or have the necessary copyright licence; and that they have the consent, authorization or other lawful basis needed to store, display, download and, where enabled, share it with connected albums. Special care is required with minors, vulnerable people, intimate situations, private events, medical information, identifying documents, addresses, schools, workplaces or other sensitive contexts. This allocation of user responsibility does not exclude duties that applicable law imposes directly on NFC Magnets.
10. Minors
The service is not aimed at children. If content concerning minors is uploaded, the person uploading it confirms that they are a parent, guardian or otherwise lawfully authorized, and that the upload respects the minor’s best interests, privacy, honour and image rights.
11. Prohibited content
Users must not upload, store, link or share content that is unlawful, abusive, threatening, defamatory, discriminatory, harassing, pornographic, exploitative, violent, fraudulent, malicious, privacy-infringing, intellectual-property-infringing, non-consensual intimate content, content involving sexualization of minors, malware, phishing material, instructions for wrongdoing or any content that may seriously harm third parties or the service.
12. Non-consensual intimate or harmful images
Non-consensual intimate images, sexualized content involving minors, content created to humiliate, blackmail or harass, and content that violates privacy or image rights may be removed immediately and may be reported to competent authorities where appropriate.
13. Personal documents and highly sensitive data
Users should not upload identity documents, financial information, medical records, passwords, addresses, geolocation details or other highly sensitive data unless strictly necessary and lawfully justified. NFC Magnets is designed for memories, not for storing legal, financial, health or identity files.
14. Accuracy of information
Users are responsible for the accuracy of names, descriptions, dates and other information added to albums. NFC Magnets does not verify the truthfulness of memories, captions or dates.
15. Technical upload limits
Albums may include limits on number of images, video slots, file size, file type, duration, dimensions and total use. Current technical controls may include images in jpg, jpeg, png or webp up to 20 MB and videos in mp4, mov or webm up to 60 seconds and approximately 75 MB after processing, subject to change for security, performance or product reasons.
Video is an optional feature and is not included in every album. It is available only while both the platform-wide video setting and the setting for the relevant magnet batch are enabled. If either is disabled, video controls and previously uploaded videos may become unavailable or hidden without the underlying files necessarily being deleted. Video allowances may also vary according to album capacity.
16. Processing of media files
Uploaded media may be validated, stored in private storage, compressed, resized, converted, thumbnailed, sorted, displayed, made downloadable and associated with metadata such as upload time, display date, file size, dimensions or duration. These operations are part of the service.
17. Deletion of content
Album holders may delete individual or selected content through available controls. Deletion may initially be logical or soft deletion for technical, recovery, security or evidence-preservation reasons, followed by physical deletion under internal processes where applicable.
18. Downloads and backups
Where enabled, users may download individual files or a package of album memories. NFC Magnets strongly recommends keeping independent backups. The service is not a substitute for cloud backup, offline backup, archival storage or professional preservation services.
During activation, the user may optionally ask NFC Magnets to send the album photos to the registered email around 10 years after activation, if the service is still operating, the email is valid and the album content remains available. This is a reminder-style operational option, not a guaranteed archival commitment.
19. Shared gallery and connections
Shared galleries are optional and may be enabled or disabled platform-wide. At present, a connection starts when one authenticated album sends a request using the other magnet’s code or link and becomes active only after the recipient accepts it using that recipient album’s PIN. Possession of a code or a pending request alone does not authorize access.
While a connection is active and both magnets remain active, people with valid access to either connected album may view and download the photos, descriptions and display dates made available through the shared-gallery interface. The current shared gallery does not share uploaded video files. Connecting does not transfer ownership and does not create a separate copy inside the other album, but a recipient may download a copy to their own device. Once downloaded, that external copy is outside NFC Magnets’ technical control and cannot be withdrawn by unlinking the albums.
Either side may unlink the connection, after which shared access through the service stops. A blocked magnet is excluded while blocked. The feature may be suspended for security, legal or product reasons. Before connecting albums, users must make sure every shared photo may lawfully be shown to everyone who can access the connected album.
20. Branding and product presentation
Albums may display NFC Magnets branding, batch branding, logos, cover images, landing texts, booking buttons or visual elements configured by the administrator or batch owner. These elements are part of the product experience and may coexist with user content.
21. Booking or external action buttons
If an album includes booking, contact or external action buttons, those links may lead to third-party services. NFC Magnets is not responsible for third-party websites, bookings, payments, availability, cancellations, guarantees or privacy practices outside the NFC Magnets platform.
22. Acceptable use
Users must use the service in good faith and must not attempt to bypass access controls, scan or brute-force PINs, scrape content, overload servers, reverse engineer private routes, introduce malware, exploit vulnerabilities, impersonate others, interfere with logs or use the service for illegal purposes.
23. Security measures and user cooperation
NFC Magnets may block suspicious sessions, throttle attempts, remove files, disable albums, request verification, preserve logs or take other reasonable measures to protect private content and service integrity. Users must cooperate where necessary to resolve security incidents.
24. Moderation and removal
NFC Magnets is not obliged to proactively monitor all album content. However, it may review, restrict, remove, preserve or disclose content when there is a credible complaint, legal obligation, technical risk, security incident, suspected abuse or breach of these Terms.
25. Notice and takedown
Anyone who believes that content hosted by NFC Magnets is illegal or infringes their rights may contact josenav97@gmail.com, clearly identifying the specific album or content, explaining the legal or factual basis, providing a reliable contact address and, where relevant, proof of identity, ownership or representation. NFC Magnets may acknowledge the notice, request strictly necessary information, assess it diligently and impartially, restrict or preserve the material, and communicate the decision where required. Manifestly fraudulent, abusive or insufficient notices may be rejected.
26. Intellectual property of NFC Magnets
The NFC Magnets name, logos, design, interface, software, code, texts, visual identity, workflows and technical architecture are protected. No rights are granted except the limited right to use the service as intended.
27. User intellectual property warranties
For every upload, the uploader represents and warrants that they have sufficient rights to capture or possess, upload, store, technically process, display, download and share the content within its selected audience, including copyright, image rights, privacy authorizations and permissions from people appearing in it. NFC Magnets does not verify those rights before every upload, and acceptance of a file by the system does not confirm its legality.
28. Privacy and data protection
Personal data processing is governed by the Privacy Policy. The Privacy Policy explains categories of data, purposes, legal bases, retention, recipients, rights and security measures.
29. Service availability
NFC Magnets will use reasonable efforts to keep the service available. Access may be interrupted by maintenance, hosting issues, software deployments, network incidents, cyberattacks, legal requirements, force majeure or third-party failures.
30. Changes to features
NFC Magnets may improve, modify, replace, enable, disable, limit or discontinue non-essential features, including shared galleries and video, for technical, legal, security, capacity or product reasons. Availability may differ by batch or album. NFC Magnets will seek to preserve the essential private-album function and mandatory consumer rights where reasonably possible.
31. Support and recovery
Support may be provided through email or available forms. PIN recovery or ownership assistance may require verification. NFC Magnets may refuse recovery where identity, authority or legitimacy cannot be reasonably confirmed.
32. Blocking and termination
NFC Magnets may block albums, suspend uploads, remove access or terminate service where there is abuse, non-payment where applicable, legal risk, security compromise, rights infringement, prohibited content, fraudulent use or serious breach of these Terms.
33. Physical product limitations
NFC operation depends on device compatibility, NFC settings, antenna position, operating system behavior, cases, metal surfaces, damage to the magnet or environmental conditions. Access to photos depends on the magnet and phone NFC working correctly, and NFC Magnets does not guarantee that every device will read the magnet in every circumstance or remain compatible indefinitely.
34. No professional advice
The service is for storing personal memories. It does not provide legal, medical, financial, archival, evidentiary or professional advice and should not be used as the sole repository for legally or professionally critical information.
35. Consumer rights and future sales
If online sales are enabled, specific product, price, tax, shipping, payment, withdrawal, exception, guarantee and customer-service information will be provided before purchase. Mandatory consumer rights remain unaffected.
36. Liability
To the extent permitted by law, NFC Magnets is not liable for user content, unauthorized access caused by credential sharing, loss due to lack of backups, third-party platform failures, device incompatibility, user misuse, unlawful uploads by users or events beyond reasonable control. Mandatory rights under consumer and data-protection law remain unaffected.
37. Indemnity
The uploader and, where applicable, the album holder may be liable for unlawful content, missing permissions, unauthorized sharing, misuse of credentials, prohibited conduct or breach of these Terms. To the extent permitted by law, they must cooperate in the defence of claims and reimburse NFC Magnets for direct, documented losses, reasonable defence costs or liabilities caused by their culpable breach. This clause does not shift NFC Magnets’ own legal responsibilities, impose disproportionate guarantees or limit mandatory consumer rights.
38. External links
The website or albums may link to third-party websites. NFC Magnets does not control those services and is not responsible for their content, security, terms or privacy practices.
39. Communications
NFC Magnets may send operational communications related to activation, security, support, policy changes, incidents or service continuity. Commercial communications, where applicable, will follow the legal basis and opt-out rules required by law.
40. Evidence preservation
To demonstrate acceptance and defend rights, NFC Magnets may create a separate electronic record containing the magnet and session identifiers, event (activation or PIN access), date and time, language, exact legal version numbers, cryptographic hashes of the legal documents, the wording accepted, IP address stored with application-level encryption, a keyed IP hash and user-agent information. The record does not prove the civil identity of the person behind a shared PIN, but it evidences the electronic action and technical context in which acceptance occurred. Such records, incident logs and strictly necessary content may be preserved for applicable limitation periods, legal claims or authority requirements.
41. Amendments
NFC Magnets may update these Terms due to legal changes, technical changes, security improvements, new features or business needs. Each version is identified by date. New users accept the current version during activation; existing albums may be asked to accept the updated version once on a later PIN access. Material changes cannot retroactively erase accrued rights or validate conduct that was unlawful when it occurred.
42. Severability
If any clause is held invalid, unlawful or unenforceable, the remaining clauses will continue to apply to the maximum extent permitted by law.
43. Applicable law and jurisdiction
These Terms are governed by Spanish law. Consumer jurisdiction rules apply where the user is a consumer. In other cases, disputes shall be submitted to the competent Spanish courts according to applicable law.
